Kentucky Mugshot Pay-to-Remove Law
KRS 61.8746 addresses a specific commercial practice. It prohibits using a booking or official inmate photograph obtained from a public agency in a commercial publication or site when removal requires a fee or other consideration. The law provides an affected person a Circuit Court remedy and escalating statutory damages.
This is an anti-pay-to-remove rule. It is not a broad declaration that every booking photograph must be placed online, kept online, or released without review.
